The best way to beat a DUI checkpoint is not to go through it. If you have been drinking, do not drive. Call a taxi or get someone else to drive you home. If you are too drunk to drive, you are too drunk to go through the checkpoint.
If you choose to go through the checkpoint, there are a few things you can do so that you can avoid getting arrested for DUI:
Be calm and polite. Not only will this make it more difficult for them to arrest you, but it will also help keep them from arresting someone who may be innocent.
Do not make any sudden movements or reach for anything unless they give permission first. This includes reaching into your pockets or purse. If they say “stop” or “don’t move”, stop moving immediately and don’t move again until they tell you that it’s okay again (this may take several seconds).
If they ask if you have been drinking alcohol tonight, tell them no and ask why they want to know this information (it could be because they suspect that something else is wrong). If they ask if anyone in your car has been drinking tonight, tell them no (even if it isn’t true) because the police might think that.
